Changes to Legislation

Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.

47Eithriad ar gyfer darparu gwasanaethau gofal iechydLL+C

(1)Ni chaiff awdurdod lleol ddiwallu anghenion person am ofal a chymorth (gan gynnwys anghenion gofalwr am gymorth) o dan adrannau 35 i 45 drwy ddarparu neu drwy drefnu i ddarparu gwasanaeth neu gyfleuster y mae’n ofynnol ei ddarparu o dan ddeddfiad iechyd, oni bai y byddai gwneud hynny yn gysylltiedig â gwneud rhywbeth arall i ddiwallu anghenion o dan yr adrannau hynny, neu’n ategol at wneud hynny.

(2)Ni chaiff awdurdod lleol sicrhau gwasanaethau neu gyfleusterau i berson o dan adran 15 (gwasanaethau ataliol) y mae’n ofynnol eu darparu o dan ddeddfiad iechyd, oni bai y byddai gwneud hynny’n gysylltiedig â sicrhau, neu’n ategol at sicrhau, gwasanaeth neu gyfleuster arall i’r person hwnnw o dan yr adran honno.

(3)Caiff rheoliadau bennu—

(a)mathau o wasanaethau neu gyfleusterau y caniateir, er gwaethaf is-adrannau (1) a (2), eu darparu neu eu trefnu gan awdurdod lleol, neu amgylchiadau y caniateir i wasanaethau neu gyfleusterau o’r fath gael eu darparu neu eu trefnu ynddynt;

(b)mathau o wasanaethau neu gyfleusterau na chaniateir iddynt gael eu darparu neu eu trefnu gan awdurdod lleol, neu amgylchiadau na chaniateir i wasanaethau neu gyfleusterau o’r fath gael eu darparu neu eu trefnu ynddynt;

(c)gwasanaethau neu gyfleusterau, neu ddull ar gyfer dyfarnu gwasanaethau neu gyfleusterau, y mae eu darparu i’w drin, neu i’w beidio â’i drin, fel pe bai’n gysylltiedig neu’n ategol at ddibenion is-adran (1) neu (2).

(4)Ni chaiff awdurdod lleol ddiwallu anghenion person am ofal a chymorth (gan gynnwys anghenion gofalwr am gymorth) o dan adrannau 35 i 45 drwy ddarparu neu drwy drefnu i ddarparu gofal nyrsio gan nyrs gofrestredig.

(5)Ni chaiff awdurdod lleol sicrhau’r ddarpariaeth o ofal nyrsio gan nyrs gofrestredig wrth gyflawni ei ddyletswyddau o dan adran 15.

(6)Ond caiff awdurdod lleol, er gwaethaf is-adrannau (1), (2), (4) a (5), drefnu i lety ynghyd â gofal nyrsio gan nyrs gofrestredig gael eu darparu—

(a)os yw’r awdurdod wedi cael cydsyniad i drefnu’r ddarpariaeth o ofal nyrsio gan—

(i)pa Fwrdd Iechyd Lleol bynnag sy’n ofynnol o dan reoliadau, yn achos llety yng Nghymru, yr Alban neu Ogledd Iwerddon, neu

(ii)pa gorff iechyd Seisnig bynnag sy’n ofynnol o dan reoliadau, yn achos llety yn Lloegr, neu

(b)mewn achos brys a lle bo’r trefniadau’n rhai dros dro.

(7)Mewn achos y mae is-adran (6)(b) yn gymwys iddo, rhaid i’r awdurdod lleol geisio cael y cydsyniad a grybwyllwyd yn is-adran (6)(a) cyn gynted ag y bo’n ddichonadwy ar ôl i’r trefniadau dros dro gael eu gwneud.

(8)Caiff rheoliadau ei gwneud yn ofynnol bod awdurdod lleol—

(a)yn gwneud trefniadau mewn cysylltiad â datrys anghydfodau rhwng yr awdurdod a chorff iechyd ynghylch p’un a yw’n ofynnol darparu gwasanaeth neu gyfleuster ai peidio o dan ddeddfiad iechyd;

(b)yn cymryd rhan yn y modd a bennir mewn prosesau ar gyfer asesu anghenion person am ofal iechyd a phenderfynu sut y dylid diwallu’r anghenion hynny.

(9)Nid oes dim yn yr adran hon yn effeithio ar yr hyn y caiff awdurdod lleol ei wneud o dan Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006, gan gynnwys ymrwymo i drefniadau o dan reoliadau a wneir o dan adran 33 o’r Ddeddf honno (trefniadau â chyrff GIG).

(10)Yn yr adran hon—

  • ystyr “corff iechyd” (“health body”) yw—

    (a)

    Bwrdd Iechyd Lleol;

    (b)

    grŵp comisiynu clinigol;

    (c)

    Bwrdd Comisiynu’r Gwasanaeth Iechyd Gwladol;

    (d)

    Bwrdd Iechyd a gyfansoddwyd o dan adran 2 o Ddeddf y Gwasanaeth Iechyd Gwladol (Yr Alban) 1978;

    (e)

    Bwrdd Iechyd Arbennig a gyfansoddwyd o dan yr adran honno;

    (f)

    ymddiriedolaeth Iechyd a Gofal Cymdeithasol;

  • ystyr “corff iechyd Seisnig” (“English health body”) yw—

    (a)

    grŵp comisiynu clinigol;

    (b)

    Bwrdd Comisiynu’r Gwasanaeth Iechyd Gwladol;

  • ystyr “deddfiad iechyd” (“health enactment”) yw—

    (a)

    Deddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006;

    (b)

    Deddf y Gwasanaeth Iechyd Gwladol 2006;

    (c)

    Deddf y Gwasanaeth Iechyd Gwladol (Yr Alban) 1978;

    (e)

    Deddf (Diwygio) Iechyd a Gofal Cymdeithasol (Gogledd Iwerddon) 2009;

  • ystyr “gofal nyrsio” (“nursing care”) yw gwasanaeth sy’n cynnwys naill ai darparu gofal neu gynllunio, goruchwylio neu ddirprwyo’r gwaith o ddarparu gofal, ond nid yw’n cynnwys gwasanaeth nad oes angen iddo, o ran ei natur a’r amgylchiadau y mae i’w ddarparu ynddynt, gael ei ddarparu gan nyrs gofrestredig.
