Changes to Legislation

Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.

77Llety i blant sy’n cael eu hamddiffyn gan yr heddlu, neu sydd o dan gadwad neu ar remánd etcLL+C

(1)Rhaid i awdurdod lleol wneud darpariaeth ar gyfer derbyn a rhoi llety i blant sy’n cael eu symud o’u cartrefi neu sy’n cael eu cadw oddi yno o dan Ran 5 o Ddeddf Plant 1989.

(2)Rhaid i awdurdod lleol dderbyn plant, a darparu llety i blant—

(a)sy’n cael eu hamddiffyn gan yr heddlu ac y gofynnir iddo eu derbyn o dan adran 46(3)(f) o Ddeddf Plant 1989;

(b)y gofynnir iddo eu derbyn o dan adran 38(6) o Ddeddf yr Heddlu a Thystiolaeth Droseddol 1984;

(c)os yr awdurdod lleol yw’r awdurdod dynodedig mewn cysylltiad â hwy a bod y plant hynny—

(i)wedi eu remandio i lety a ddarperir gan neu ar ran awdurdod lleol yn rhinwedd [F1paragraff 5 o Atodlen 4 neu baragraff 7 o Atodlen 5 i'r Cod Dedfrydu] (torri etc gorchmynion atgyfeirio a gorchmynion gwneud iawn);

(ii)wedi eu remandio i lety a ddarperir gan neu ar ran awdurdod lleol yn rhinwedd [F2paragraff 25 o Atodlen 7 i'r Cod hwnnw] (torri etc gorchmynion adsefydlu ieuenctid);

(iii)wedi eu remandio i lety a ddarperir gan neu ar ran awdurdod lleol yn rhinwedd paragraff 10 o’r Atodlen i Ddeddf Troseddau Stryd 1959 (torri gorchmynion o dan adran 1(2A) o’r Ddeddf honno);

(iv)yn destun gorchymyn adsefydlu ieuenctid sy’n gosod gofyniad preswylio awdurdod lleol neu yn destun gorchymyn adsefydlu ieuenctid â maethu.

[F3(3)Yn is-adran (2)—

  • mae i “gofyniad preswylio awdurdod lleol” (“local authority residence requirement”) yr ystyr a roddir gan baragraff 24 o Atodlen 6 i'r Cod Dedfrydu;

  • mae i “gorchymyn adsefydlu ieuenctid” (“youth rehabilitation order”) yr ystyr a roddir gan adran 173 o'r Cod hwnnw;

  • mae i “gorchymyn adsefydlu ieuenctid â maethu” (“youth rehabilitation order with fostering”) yr ystyr a roddir gan adran 176 o'r Cod hwnnw.”]

(4)Mae is-adran (5) yn gymwys—

(a) pan fo plentyn—

(i)wedi ei symud o dan Ran 5 o Ddeddf Plant 1989, neu

(ii)wedi ei gadw’n gaeth o dan adran 38 o Ddeddf yr Heddlu a Thystiolaeth Droseddol 1984, a

(b)pan nad yw’r plentyn yn cael llety a ddarperir—

(i)gan awdurdod lleol [F4neu awdurdod lleol yn Lloegr], neu

(ii)mewn ysbyty a freiniwyd yng Ngweinidogion Cymru, Ymddiriedolaeth GIG, Ymddiriedolaeth Sefydledig GIG neu’r Ysgrifennydd Gwladol, neu sydd fel arall wedi ei roi ar gael yn unol â threfniadau a wnaed gan Fwrdd Iechyd Lleol, Ymddiriedolaeth GIG, Ymddiriedolaeth Sefydledig GIG, Gweinidogion Cymru, yr Ysgrifennydd Gwladol, [F5GIG Lloegr] neu [F6fwrdd gofal integredig] .

(5)Gellir adennill unrhyw gostau rhesymol a dynnwyd wrth roi llety i’r plentyn oddi wrth yr awdurdod lleol [F7neu’r awdurdod lleol yn Lloegr] y mae’r plentyn yn preswylio fel arfer yn ei ardal.
