Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 95 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 09 Gorffennaf 2024. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Pan fo plentyn yn derbyn gofal gan awdurdod lleol, rhaid i’r awdurdod, oni bai nad yw hynny’n rhesymol ymarferol neu yn gyson â llesiant y plentyn, hyrwyddo cyswllt rhwng y plentyn a—
(a)rhieni’r plentyn,
(b)unrhyw berson nad yw’n rhiant i’r plentyn ond sydd â chyfrifoldeb rhiant dros y plentyn, ac
(c)unrhyw berthynas, ffrind neu unrhyw berson arall sy’n gysylltiedig â’r plentyn.
(2)Pan fo plentyn yn derbyn gofal gan awdurdod lleol, rhaid i’r awdurdod lleol gymryd unrhyw gamau sy’n rhesymol ymarferol i sicrhau bod y personau canlynol yn cael eu hysbysu’n rheolaidd am y man lle y mae’r plentyn yn cael ei letya—
(a)rhieni’r plentyn;
(b)unrhyw berson nad yw’n rhiant i’r plentyn ond sydd â chyfrifoldeb rhiant dros y plentyn.
(3)Rhaid i bob person a grybwyllwyd yn is-adran (2)(a) neu (b) sicrhau bod yr awdurdod yn cael ei hysbysu’n rheolaidd am ei gyfeiriad.
(4)Pan fo awdurdod lleol (“yr awdurdod derbyn”) yn cymryd drosodd y gwaith o ddarparu llety i blentyn [F1oddi wrth awdurdod lleol neu awdurdod lleol yn Lloegr o dan adran 76 (“yr awdurdod trosglwyddo”)]—
(a)rhaid i’r awdurdod derbyn (pan fo hynny’n rhesymol ymarferol) hysbysu—
(i)rhieni’r plentyn, a
(ii)unrhyw berson nad yw’n rhiant i’r plentyn ond sydd â chyfrifoldeb rhiant dros y plentyn,
(b)mae is-adran (2) yn gymwys i’r awdurdod trosglwyddo, yn ogystal â’r awdurdod derbyn, hyd nes y bydd o leiaf un o’r personau a grybwyllwyd ym mharagraff (a) neu (b) o’r is-adran honno wedi cael ei hysbysu am y newid, ac
(c)nid yw is-adran (3) yn ei gwneud yn ofynnol i unrhyw berson hysbysu’r awdurdod derbyn am ei gyfeiriad hyd nes y bydd y person hwnnw wedi cael ei hysbysu o dan baragraff (a).
(5)Nid oes dim yn yr adran hon sy’n ei gwneud yn ofynnol i awdurdod lleol hysbysu person am y man lle y mae plentyn, ac eithrio plentyn o dan 16 oed sy’n cael ei letya o dan adran 76, os oes gan yr awdurdod sail resymol dros gredu y byddai hysbysu’r person yn peryglu llesiant y plentyn.
(6)Mae unrhyw berson sy’n methu â chydymffurfio, heb esgus rhesymol, ag is-adran (3) yn euog o drosedd ac yn atebol o’i gollfarnu’n ddiannod i ddirwy nad yw’n uwch na lefel 2 ar y raddfa safonol.
