(1)Mae’n drosedd i berson, gyda’r bwriad o gymell awdurdod tai lleol i gredu mewn cysylltiad ag arfer ei swyddogaethau o dan y Bennod hon bod y person neu berson arall â’r hawl i lety neu gynhorthwy yn unol â darpariaethau’r Bennod hon, neu â’r hawl i lety neu gynhorthwy o ddisgrifiad penodol—
(a)gwneud datganiad sy’n anwir mewn unrhyw fanylyn perthnasol, yn fwriadol neu’n ddi-hid, neu
(b)celu yn fwriadol wybodaeth y mae’r awdurdod wedi ei gwneud yn rhesymol ofynnol iddo ei rhoi mewn cysylltiad ag arfer y swyddogaethau hynny.
(2)Os oes unrhyw newid yn y ffeithiau sy’n berthnasol i’r achos, a hynny cyn i geisydd dderbyn hysbysiad am benderfyniad yr awdurdod tai lleol am y cais, rhaid i’r ceisydd hysbysu’r awdurdod cyn gynted â phosibl.
(3)Rhaid i’r awdurdod egluro i bob ceisydd, mewn iaith arferol, y ddyletswydd a osodir gan is-adran (2) ac effaith is-adran (4).
(4)Mae person sy’n methu â chydymffurfio ag is-adran (2) ar ôl derbyn yr esboniad sy'n ofynnol gan is-adran (3) yn cyflawni trosedd.
(5)Mewn achos yn erbyn person am drosedd a gyflawnwyd o dan is-adran (4) mae’r ffaith bod gan y person esgus rhesymol am fethu â chydymffurfio yn amddiffyniad.
(6)Mae person sy’n euog o drosedd o dan yr adran hon yn agored, ar gollfarn ddiannod, i ddirwy nad yw’n uwch na lefel 4 ar y raddfa safonol.
