Mae’r fersiwn hon o'r ddarpariaeth hon yn rhagolygol.
Defnyddir y term darpariaeth i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – megis Rhan, Pennod neu adran. Mae fersiwn o ddarpariaeth yn rhagolygol naill ai:
Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.
Ar hyn o bryd nid oes unrhyw effeithiau heb eu gweithredu yn hysbys ar gyfer y Deddf Rheoleiddio ac Arolygu Gofal Cymdeithasol (Cymru) 2016, Adran 59.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
Rhagolygol
(1)Rhaid i Weinidogion Cymru drwy reoliadau bennu meini prawf ar gyfer dyfarnu a yw (yn ddarostyngedig i reoliadau o dan is-adran (4)) adran 61 yn gymwys i ddarparwr gwasanaeth mewn cysylltiad â gwasanaethau rheoleiddiedig.
(2)Wrth bennu’r meini prawf, rhaid i Weinidogion Cymru roi sylw i’r materion a ganlyn yn benodol—
(a)faint o ofal a chymorth a ddarperir gan ddarparwr gwasanaeth,
(b)crynodiad daearyddol busnes darparwr gwasanaeth, ac
(c)y graddau y mae darparwr gwasanaeth yn arbenigo yn y ddarpariaeth o fathau penodol o wasanaeth rheoleiddiedig.
(3)Rhaid i Weinidogion Cymru—
(a)ar yr adegau hynny sy’n briodol yn eu barn hwy, adolygu’r meini prawf a bennir am y tro yn y rheoliadau, a
(b)cyhoeddi gwybodaeth ynghylch sut y mae’r materion a grybwyllir yn is-adran (2), ac unrhyw faterion eraill y maent yn rhoi sylw iddynt wrth bennu’r meini prawf, i gael eu mesur.
(4)Caiff Gweinidogion Cymru drwy reoliadau ddarparu nad yw adran 61 yn gymwys, neu nad yw ond yn gymwys i’r graddau a bennir, i ddarparwr gwasanaeth penodedig neu i ddarparwr gwasanaeth o ddisgrifiad penodedig, pa un a fyddai’r darparwr gwasanaeth hwnnw neu ddarparwr gwasanaeth o’r disgrifiad hwnnw yn bodloni’r meini prawf ai peidio.
(5)Mae’r amgylchiadau pan ganiateir i reoliadau gael eu gwneud o dan is-adran (4) yn cynnwys yr amgylchiadau hynny pan fo Gweinidogion Cymru wedi eu bodloni bod darparwyr gwasanaethau penodol eisoes yn ddarostyngedig i gyfundrefn reoleiddiol sy’n gymaradwy â’r hyn y darperir ar ei chyfer yn adrannau 61 a 62; a chaiff rheoliadau a wneir o dan amgylchiadau o’r fath, er enghraifft, wneud darpariaeth sy’n ei gwneud yn ofynnol i bersonau penodedig gydweithredu neu rannu gwybodaeth o ddisgrifiad penodedig.
(6)Cyn gwneud rheoliadau o dan yr adran hon rhaid i Weinidogion Cymru ymgynghori ag unrhyw bersonau sy’n briodol yn eu barn hwy.
(7)Ond nid yw’r gofyniad i ymgynghori yn gymwys i reoliadau—
(a)sy’n diwygio rheoliadau eraill a wneir o dan yr adran hon, a
(b)nad ydynt, ym marn Gweinidogion Cymru, yn rhoi effaith i unrhyw newid sylweddol yn y ddarpariaeth a wneir gan y rheoliadau sydd i’w diwygio.
