27Cyfyngiadau ar wneud pethau at ddiben masnachol wrth arfer y pŵer cyffredinol

(1)Nid yw’r pŵer cyffredinol yn rhoi pŵer i awdurdod lleol cymhwysol wneud pethau at ddiben masnachol onid ydynt yn bethau y caiff yr awdurdod, wrth arfer y pŵer cyffredinol, eu gwneud heblaw at ddiben masnachol.
(2)Pan fo awdurdod lleol cymhwysol, wrth arfer y pŵer cyffredinol, yn gwneud pethau at ddiben masnachol, rhaid i’r awdurdod eu gwneud drwy gyfrwng cwmni.
(3)Ni chaiff awdurdod lleol cymhwysol, wrth arfer y pŵer cyffredinol, wneud pethau at ddiben masnachol mewn perthynas â pherson os yw unrhyw ddeddfiad yn ei gwneud yn ofynnol i’r awdurdod wneud y pethau hynny mewn perthynas â’r person.
(4)Yn yr adran hon, ystyr “cwmni” yw—
(a)cwmni o fewn ystyr adran 1(1) o Ddeddf Cwmnïau 2006 (p. 46), neu
(b)cymdeithas gofrestredig o fewn ystyr Deddf Cymdeithasau Cydweithredol a Budd Cymunedol 2014 (p. 14) neu Ddeddf Cymdeithasau Cydweithredol a Budd Cymunedol (Gogledd Iwerddon) 1969 (p. 24 (GI)).
(5)Rhaid i awdurdod lleol cymhwysol roi sylw i unrhyw ganllawiau a ddyroddir gan Weinidogion Cymru ynglŷn â gwneud pethau, wrth arfer y pŵer cyffredinol, at ddiben masnachol.
