22Amodau eithriadol yn y farchnad: y pwerau sydd ar gael i Weinidogion Cymru

(1)Mae’r adran hon yn gymwys yn ystod y cyfnod y mae datganiad amodau eithriadol yn y farchnad yn cael effaith.

(2)Caiff Gweinidogion Cymru ddarparu, neu gytuno i ddarparu, cymorth ariannol i gynhyrchwyr amaethyddol yng Nghymru y mae’r amodau eithriadol yn y farchnad a ddisgrifir yn y datganiad wedi cael, yn cael, neu’n debygol o gael, effaith andwyol ar eu hincwm.

(3)Nid oes dim yn yr adran hon yn effeithio ar unrhyw bwerau eraill sydd ar gael i Weinidogion Cymru (gan gynnwys o dan ddeddfwriaeth uniongyrchol yr UE a ddargedwir) i ddarparu cymorth ariannol i gynhyrchwyr amaethyddol.

(4)Caniateir darparu cymorth ariannol o dan is-adran (2) drwy grant, benthyciad neu warant neu ar unrhyw ffurf arall.

(5)Caniateir darparu’r cymorth ariannol yn ddarostyngedig i unrhyw amodau y mae Gweinidogion Cymru yn ystyried eu bod yn briodol.

(6)Caniateir i’r amodau (ymysg pethau eraill) gynnwys darpariaeth i gymorth ariannol gael ei ad-dalu neu ar gyfer gwneud iawn amdano fel arall (gyda llog neu beidio).

(7)Nid oes dim yn is-adran (1) na (2) yn atal Gweinidogion Cymru rhag darparu, neu gytuno i ddarparu, cymorth ariannol o dan is-adran (2) ar ôl diwedd y cyfnod y mae’r datganiad amodau eithriadol yn y farchnad yn cael effaith ynddo, ond mewn ymateb i gais a wneir yn ystod y cyfnod hwnnw.
