17 Appeals to the [Investigatory Powers Commissioner] : supplementaryS

(1)On determining an appeal under section 16 above, the [Investigatory Powers Commissioner] shall give notice of the determination to both—
(a)the person by whom the appeal was brought; and
(b)the [Judicial Commissioner] whose decision was appealed against.
(2)Where the determination of the [Investigatory Powers Commissioner] on an appeal under section 16 above is a determination to dismiss the appeal, the [Investigatory Powers Commissioner] shall make a report of the findings—
(a)to the persons mentioned in subsection (1) above; and
(b)to the Scottish Ministers.
(3)Subject to subsection (2) above, the [Investigatory Powers Commissioner] shall not give any reasons for any determination of the Commissioner on an appeal under section 16 above.
