21Orders and regulations

(1)

Any power of the Scottish Ministers under this Act to make an order or regulations is exercisable by statutory instrument.

(2)

Any such power includes power to make—

(a)

different provision for different cases and for different classes of case; and

(b)

such incidental, supplementary, consequential, transitional, transitory or saving provision as the Scottish Ministers think necessary or expedient.

(3)

Subject to subsection (4) below, a statutory instrument containing an order (other than an order made under section 22(2) below) or regulations made under this Act is subject to annulment in pursuance of a resolution of the Scottish Parliament.

(4)

A statutory instrument containing an order made under section 10(10) or 12(3) above or paragraph 13 of schedule 2 to this Act shall not be made unless a draft of the instrument has been laid before, and approved by a resolution of, the Scottish Parliament.
