9Persons against whom burdens are enforceableS

This section has no associated Explanatory Notes

(1)An affirmative burden is enforceable against the owner of the burdened property.

(2)A negative burden or an ancillary burden is enforceable against—

(a)the owner, or tenant, of the burdened property; or

(b)any other person having the use of that property.
