I1C12Offence of smoking in no-smoking premises

A person who smokes in no-smoking premises commits an offence.

It is a defence for an accused charged with an offence under this section to prove that the accused did not know, and could not reasonably be expected to have known, that the place in which it is alleged that the accused was smoking was no-smoking premises.

A person guilty of an offence under this section is liable, on summary conviction, to a fine not exceeding level 3 on the standard scale.
