Police, Public Order and Criminal Justice (Scotland) Act 2006 Explanatory Notes

The Act

3.This Act introduces a range of measures and is in 4 parts, as follows:

4.Part 1 (Police) contains provisions to establish the Scottish Police Services Authority, the Scottish Crime and Drug Enforcement Agency and the Police Complaints Commissioner for Scotland. Further provisions concern allowances payable to special constables, appointments of assistant inspectors and staff officers in Her Majesty’s Inspectorate of Constabulary for Scotland, and amendments to the provisions of the Police (Scotland) Act 1967 in respect of constables engaged on service outside their force.

5.Part 2 (Public Order etc.) contains provisions which introduce football banning orders, amend the provisions of the Civic Government (Scotland) Act 1982 concerning public processions, make changes to legislation in respect of offensive weapons, introduce police powers of search and arrest in respect of fireworks offences, and amend the legislation on control of sex offenders.

6.Part 3 (Criminal Justice) contains provisions giving the police additional powers in relation to suspects and witnesses and to retain samples etc in connection with prosecutions for sexual and violent offences. Further provisions introduce drug testing and assessment for certain arrested persons, a range of incentives for offenders to assist investigations and prosecutions, and amendments to the Sea Fisheries (Shellfish) Act 1967 to introduce powers of enforcement of regulated fisheries.

7.Part 4 (General) concerns provisions on equal opportunities and supporting provisions in respect of modifications, ancillary powers and subordinate legislation.
