The Scottish Public Services Ombudsman Act 2002 is amended as follows.

In schedule 2 (listed authorities)—
a
the entry numbered 14 is repealed; and
b
after the entry numbered 32 there is inserted—
32A
The Police Complaints Commissioner for Scotland.

In schedule 4 (matters which the Ombudsman must not investigate)—
a
for paragraph 1(b) there is substituted—

by the Police Complaints Commissioner for Scotland,
b
after paragraph 15 there is inserted—

Action taken—
a
by a local authority in discharge of its functions as a police authority, or
b
by any other person in discharge of the functions of a local authority as a police authority, by virtue of section 56(1) of the Local Government (Scotland) Act 1973 (c. 65).
