29Police duties after arrest

(1)

The officer in charge of a police station to which any person arrested under section 28 is taken (“the officer in charge”) must detain the arrested person in custody until the person is—

(a)

accused on petition or charged on complaint with an offence in respect of the facts and circumstances which gave rise to the arrest, or

(b)

brought before the sheriff under section 32.

(2)

The officer in charge must ensure that the facts and circumstances which gave rise to the arrest are reported to the fiscal as soon as is practicable.
