This Act binds the Crown.

No contravention by the Crown of any provision made by or under this Act makes the Crown criminally liable; but the provisions of this Act and any provisions made under it apply to persons in the service of the Crown as they apply to other persons.

The Court of Session may, on the application of the Lord Advocate, declare unlawful any act or omission of the Crown which constitutes a contravention of any provision made by or under this Act.
