Chapter 2Confinement, review and release of prisoners

Compassionate release on licence

27C1Compassionate release on licence

Where the Scottish Ministers are satisfied that there are compassionate grounds justifying the release on licence of a prisoner, the Scottish Ministers may release the prisoner on licence.

Before releasing a custody and community prisoner or a life prisoner under subsection (1) the Scottish Ministers must consult the Parole Board.

The Scottish Ministers need not consult the Parole Board if it is impracticable to do so.
