Appointment of JPs etc.
73Disqualification where sequestration or bankruptcy

A person is disqualified from being appointed as, or acting as, a JP if—
a
the person's estate has been sequestrated in Scotland, or
b
the person has been adjudged bankrupt outwith Scotland.

Where a person is disqualified under subsection (1)(a), the disqualification ceases if—
a
the award of sequestration is recalled or reduced, or
b
the person is discharged by virtue of the Bankruptcy (Scotland) Act 1985 (c. 66).

Where a person is disqualified under subsection (1)(b), the disqualification ceases if—
a
the adjudication of bankruptcy against the person is annulled, or
b
the person is discharged.
