43Orders and regulations

Any Ministerial power to make an order or regulations under this Act is exercisable by statutory instrument.

Any such power includes power to make—

a

any supplementary, incidental, consequential, transitional, transitory or saving provision which Ministers consider appropriate,

b

different provision for different purposes.

Subject to subsection (4), a statutory instrument containing an order or regulations made under this Act is subject to annulment in pursuance of a resolution of the Scottish Parliament.

This subsection does not apply to orders made under section 49(2) (commencement orders) or 50(2) (repeal order).

No statutory instrument containing the first—

a

trading regulations,

b

advertising regulations, or

c

regulations under section 19,

may be made unless a draft of the instrument has been laid before, and approved by a resolution of the Scottish Parliament.
