Decision whether to apply for order forfeiting propertyS

5(1)Where a notice of claim in respect of the property is duly served in accordance with paragraph 3, the Scottish Ministers must decide whether to make an application to a sheriff for an order forfeiting the property (a “forfeiture application”).S

(2)The decision whether to make such an application must be taken as soon as reasonably practicable after receipt of the notice of claim.
