6(1)If, in a case in which a notice of claim has been duly served, the Scottish Ministers decide not to make a forfeiture application in respect of the property, they must return the property to a person appearing to them to be an owner of the property.S
(2)The property must be returned as soon as reasonably practicable after the decision not to make a forfeiture application.
