44Subordinate legislation
1
Any power conferred by this Act on the Scottish Ministers to make an order or regulations includes the power to make—
a
different provision for different cases or descriptions of case or for different purposes,
b
such incidental, supplementary, consequential, transitional, transitory or saving provision as the Scottish Ministers consider necessary or expedient.

Orders or regulations made under the following provisions are subject to the affirmative procedure—
a
section 1(2),
b
section 3(3),
c
section 4(2),
d
section 7(1),
e
section 14(1),
f
section 15(6),
g
section 25(5),
h
section 40,
i
section 41(2),
j
section 43 (but only if the order adds to, replaces or omits any part of the text of an Act).

Any other orders or regulations made under this Act are subject to the negative procedure.

This section does not apply to an order under section 45(2).
