41Power to confer all-Scotland jurisdiction for specified cases

The Scottish Ministers may by order provide that the jurisdiction of a sheriff of a specified sheriffdom sitting at a specified sheriff court extends territorially throughout Scotland for the purposes of dealing with specified types of civil proceedings.

In subsection (1), “specified” means specified in an order under that subsection.

An order under subsection (1) may be made only with the consent of the Lord President of the Court of Session.

An order under subsection (1) does not affect—
a
in relation to the sheriffdom specified in the order, the jurisdiction or competence of a sheriff of any other sheriffdom to deal with proceedings of the type specified in the order, or
b
in relation to the sheriff court specified in the order, the jurisdiction or competence of a sheriff sitting at any other sheriff court to deal with such proceedings.

This section does not apply in relation to proceedings under the Children's Hearings (Scotland) Act 2011.
