Simple procedure

I175Rule-making: matters to be taken into consideration

The power to make provision relating to simple procedure by act of sederunt under section 104(1) is to be exercised so far as possible with a view to ensuring that the sheriff before whom a simple procedure case is conducted—

a

is able to identify the issues in dispute,

b

may facilitate negotiation between or among the parties with a view to securing a settlement,

c

may otherwise assist the parties in reaching a settlement,

d

can adopt a procedure that is appropriate to and takes account of the particular circumstances of the case.
