60Subordinate legislation

Each power of the Scottish Ministers to make an order or regulations under this Act includes power—
a
to make different provision for different purposes,
b
to make any supplementary, incidental, consequential, transitory, transitional or saving provision which they consider appropriate.

The following are subject to the affirmative procedure—
a
an order under section 35(1),
b
regulations under section 49(1) which modify section 38 or 45,
c
regulations under section 49(7),
d
an order under section 61 which adds to, replaces or omits any part of the text of this or any other Act.

All other orders and regulations under this Act are subject to the negative procedure.

Subsections (1) and (3) do not apply to an order under section 63(2).
