Part 10: Participation in public decision making

Participation in decisions of certain persons exercising public functions

447.Section 139 provides a regulation-making power enabling the Scottish Ministers to require Scottish public authorities to promote and facilitate the participation of members of the public in the decisions and activities of the authority, including the allocation of resources. Subsection (5) provides that the regulations can confer functions on authorities, specify the activities to which the regulations can apply, and require the authorities to prepare and publish a report. The authorities must also have regard to any guidance issued by the Scottish Ministers.
