Registers of relevant authorities’ land

94Duty to publish register of land

Each relevant authority must establish and maintain a register of land mentioned in subsection (2).

The land is land which, to the best of the authority’s knowledge and belief, is owned or leased by the authority.

Every relevant authority must—

a

make arrangements to enable members of the public to inspect, free of charge, its register of land at reasonable times and at such places as the authority may determine, and

b

make its register of land available on a website, or by other electronic means, to members of the public.

The Scottish Ministers may by regulations specify land, or descriptions of land, that a relevant authority need not include in its register of land.

Relevant authorities must have regard to any guidance issued by the Scottish Ministers in relation to the duties imposed on the authorities under this section.

Before issuing such guidance, the Scottish Ministers must consult the relevant authorities.

The omission of any land owned or leased by a relevant authority from the authority’s register of land does not prevent an asset transfer request being made in respect of the land.
