The Mental Health (Care and Treatment) (Scotland) Act 2003 is amended as follows.

In section 24 (provision of services and accommodation for certain mothers with post-natal depression)—
a
in paragraph (d) of subsection (1), for the words “for post-natal depression,” there is substituted
for—
i
post-natal depression; or
ii
a mental disorder (other than post-natal depression),
b
after subsection (1) there is inserted—

But a Health Board is required to provide services and accommodation under subsection (1) above only if it is satisfied that doing so would be beneficial to the wellbeing of the child.
