The Lord Advocate must make available to the public a statement setting out in general terms the matters about which a prosecutor requires to be satisfied in order to initiate, and continue with, criminal proceedings in respect of any offence.

The reference in subsection (1) to a prosecutor is to one within the Crown Office and Procurator Fiscal Service.
