F2(1)The Ministry may, subject to and in accordance with the provisions of this Part and Part IV, grant to any person applying therefor a licence (in this Act referred to as a [F3“bus operator's licence”)] for the carriage of passengers and their luggage by road.
(2)Subject toF4. . . regulations made under section 45, no person shall use a motor vehicle, or cause or permit such a motor vehicle to be used, on a road to carry passengers and their luggage for reward except under a licence granted under subsection (1).
(3)For the purposes of this section a motor vehicle used to carry passengers and their luggage for reward shall not be deemed to be used under a [F5bus operator's] licence unless it is used by or on behalf of the holder of the licence and in accordance with the conditions applicable to the licence.
(4)Any person who acts in contravention of subsection (2) [F6 or who contravenes a requirement of any such directly applicable Community provision as is referred to in section 45( j) as to the keeping or production of any document] shall be guilty of an offence and be liable on summary conviction to a fine not exceeding[F7 level 5 on the standard scale].
