Article 9U.K.
Tendering securities shall be released:
(a)
where tenders are not accepted;
(b)
when the successful tenderer has provided proof that the security provided for in Article 12 of Commission Regulation (EC) No 1342/2003(1) has been submitted.
Where the undertaking referred to in Article 5(3)(b) is not fulfilled, the tendering security shall be forfeited except in cases of force majeure.
