ENVIRONMENTAL PROTECTION

The Waste and Contaminated Land (1997 Order) (Commencement No. 2) Order (Northern Ireland) 1998

The Department of the Environment, in exercise of the powers conferred on it by Article 1(2) of the Waste and Contaminated Land (Northern Ireland) Order 1997(1) and paragraph 2(1) of Schedule 1 to the Northern Ireland Act 1974(2) and of every other power enabling it in that behalf, hereby makes the following order:

Citation

1.  This order may be cited as the Waste and Contaminated Land (1997 Order) (Commencement No. 2) Order (Northern Ireland) 1998.

Appointed Day

2.  The following provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997 shall come into operation on 1st December 1998–

  • Articles 2(2) (in so far as it relates to the definitions of “environment”, “harm”, “harmless”, “pollution of the environment”, “prescribed”, “substance”, “recover”, “waste” and “the Waste Directive”), and (6),

  • Article 19,

  • Article 32,

  • Article 33,

  • Schedule 1,

  • Schedule 3.

Explanatory Note

(This note is not part of the Order.)

This order brings into operation on the 1st day of December 1998 certain provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997 which enable the Department to make a Waste Strategy and which empower the Department to control the marketing and use of injurious substances and to obtain information about potentially hazardous substances.

The Waste and Contaminated Land (1997 Order) (Commencement No. 1) Order (Northern Ireland) 1998 brought into operation on the 17th day of September 1998 the following provisions of the Waste and Contaminated Land (Northern Ireland) Order 1997—

  • Article 1,

  • Article 2(1), (2) (partially), (3), (7) and (8),

  • Article 5 (in so far as it relates to the definition of “broker”),

  • Article 30,

  • Article 44 (in so far as it relates to the Department),

  • Article 48,

  • Article 76,

  • Articles 78 to 82,

  • Paragraph 4 of Schedule 5 and Article 83(1) in so far as it relates to it,

  • Schedule 6 and Article 83(2) (partially).
