Amendment of the Register Regulations

3.  For regulation 5 of the Register Regulations (offences and penalties) there shall be substituted the following regulation—

5.(1) Where any person, without reasonable cause, fails to comply with the duty imposed under regulation 6(2) he is guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.

(2) Where any person, without reasonable cause, fails to comply with any duty imposed by regulation 2, 3 or 6(3) the Occupational Pensions Regulatory Authority(1) may require that person to pay within 28 days a penalty which shall—

(a)in the case of an individual, not exceed £1,000; and

(b)in any other case, not exceed £10,000..
