The Primary Medical Services (2004 Order) (Commencement) Order (Northern Ireland) 2004

The Department of Health, Social Services and Public Safety, in exercise of the powers conferred on it by Article 1(3) of the Primary Medical Services (Northern Ireland) Order 2004(1) and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Primary Medical Services (2004 Order) (Commencement) Order (Northern Ireland) 2004.

(2) In this Order:

“the 2004 Order” means the Primary Medical Services (Northern Ireland) Order 2004.

Appointed days

2.—(1) The day appointed for the coming into operation of Article 3 (Provision of Primary Medical Services), Article 4 (General Medical Services Contracts) and Article 8 (Persons Performing Primary Medical Services) –

(a)for the purposes only of making regulations and directions is 18th March 2004; and

(b)for all other purposes, is 1st April 2004.

(2) The day appointed for the coming into operation of the remaining provisions of the 2004 Order which require to be commenced is 1st April 2004.

Article 2(1)

SCHEDULE

Provisions of the 2004 OrderPurpose
Article 3Only for the purpose of enabling regulations under Article 56(5) and (6) of the 1972 Order to come into operation on 1st April 2004
Article 4Only for the purpose of enabling a Health and Social Services Board to make and enter into a general medical services contract under Articles 57 and 57A of the 1972 Order, giving directions under 57C and making regulations under Articles 57B(4), 57E and 57F of that Order to come into operation on 1st April 2004
Article 8Only for the purpose of making regulations under Article 57G of the 1972 Order to come into operation on 1st April 2004

Explanatory Note

(This note is not part of the Order.)

This Order brings into operation all of the provisions of the Primary Medical Services (Northern Ireland) Order 2004 (“the Order”), with the exception of Articles 1, 2, 5 and 11 which came into operation on the date of Royal Assent on 11th February 2004.

Article 2(1) brings Articles 3, 4 and 8 of the Order into operation, only for the purposes of making regulations and directions, on 18th March 2004 and for all other purposes on 1st April 2004.

Article 2(2) brings into operation on 1st April 2004 all remaining provisions of the Order which require to be commenced.
