Grammar Schools (Charges) (Amendment) Regulations (Northern Ireland) 2004

The Department of Education, in exercise of the powers conferred on it by Article 132(2) and (3) of the Education Reform (Northern Ireland) Order 1989(1) and of every other power enabling it in that behalf, hereby makes the following Regulations:
Citation, commencement and interpretation
1.—(1) These Regulations may be cited as the Grammar Schools (Charges) (Amendment) Regulations (Northern Ireland) 2004 and shall come into operation on 1st September 2004.
(2) In these Regulations “the Order” means the Education Reform (Northern Ireland) Order 1989.
Revocation
2. The Grammar Schools (Charges) (Amendment) Regulations (Northern Ireland) 1995(2) are hereby revoked.
Amendment to the Grammar Schools (Charges) Regulations (Northern Ireland) 1992
3. In the Grammar Schools (Charges) Regulations (Northern Ireland) 1992(3) for regulation 6 (Capital charges in voluntary schools to which Articles 128 to 131 of the Order apply) there shall be substituted –
“6. The amount of any charge which the Board of Governors of a voluntary school to which Articles 128 to 131 of the Order apply may make under Article 132 or 132A of the Order in respect of any pupil enrolled in the secondary department of that school shall not exceed £110”.

Explanatory Note
(This note is not part of the Regulations.)
These Regulations amend the Grammar Schools (Charges) Regulations (Northern Ireland) 1992 and revoke the Grammar Schools (Charges) (Amendment) Regulations (Northern Ireland) 1995.
In relation to a voluntary grammar school to which Articles 128 to 132 of the Education Reform (Northern Ireland) Order 1989 apply, the Board of Governors may charge only in respect of a pupil enrolled in the secondary department of the school for the purpose of meeting expenditure on the provision or alteration of school premises or on the provision of associated equipment.
These Regulations increase the maximum amount which the Board of Governors may charge from £80 to £110.
