The Department of the Environment makes the following Regulations in exercise of the powers conferred by Articles 5(6), 6(5), 10 and 129(1) of the Planning (Northern Ireland) Order 1991(1).
1. These regulations may be cited as the Planning (Development Plans) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 17th October 2006.
2. The Planning (Development Plans) Regulations (Northern Ireland) 1991(2) shall be amended in accordance with regulations 3 to 6.
3. In the shoulder note to regulation 11 (public local inquiries) for the words “public local inquiries” there shall be substituted “independent examinations”.
4. In regulations 11, 12 and 13(1)(f) for the words “a public local inquiry” there shall be substituted “an independent examination”.
5. In the shoulder note to regulation 12 (report of public local inquiry) and in regulation 13(1)(e) for the words “public local inquiry” there shall be substituted “independent examination”.
6. In regulations 11 and 13 for the word “inquiry” there shall be substituted “examination”.

These regulations amend regulations 11, 12 and 13 of the Planning (Development Plans) Regulations (Northern Ireland) 1991 to replace references in regulations 11, 12 and 13 to “public local inquiries”, “public local inquiry” and “inquiry” by references to “independent examinations”, “independent examination” and “examination”.
The amendments are required following substitution of Article 7 of and amendment to Article 8 of the Planning (Northern Ireland) Order 1991 by the Planning Reform (Northern Ireland) Order 2006 (No. 1252 (N.I. 7)) to provide for independent examination for the purpose of considering objections to a development plan or to the alteration, repeal or replacement of a development plan.
