The Department for Social Development makes the following Order in exercise of the powers conferred by sections 59 and 60(1) of the Welfare Reform Act (Northern Ireland) 2007(1).

Citation, commencement and interpretationN.I.

1.—(1) This Order may be cited as the Welfare Reform (2007 Act) (Commencement No. 4 and Consequential Provisions) Order (Northern Ireland) 2008.

(2) Article 3 shall come into operation on 1st April 2008.

(3) In this Order any reference to a numbered section or Schedule is to the section of, or Schedule to, the Welfare Reform Act (Northern Ireland) 2007 bearing that number.

2.  The day appointed for the coming into operation of—

(a)section 36 (directions by Department);

(b)section 45 (loss of benefit for commission of benefit offences); and

(c)paragraphs 2 to 4 of Schedule 5 (minor and consequential amendments) and section 37 in so far as it relates to those paragraphs,

is 1st April 2008.

Consequential provisionsN.I.

3.—(1) In paragraph 25 of Schedule 1 to the Social Security and Child Support (Decisions and Appeals) Regulations (Northern Ireland) 1999(2) (decisions against which no appeal lies) for “3 years” substitute “5 years”.

(2) In regulation 2(2) of the Social Security (Loss of Benefit) Regulations (Northern Ireland) 2002(3) (disqualification period) for “3 years” substitute “5 years”.

EXPLANATORY NOTE

(This note is not part of the Order)

Article 2 of this Order provides for the coming into operation of sections 36 (directions by Department) and 45 (loss of benefit for commission of benefit offences) of, and paragraphs 2 to 4 of Schedule 5 (minor and consequential amendments) to, the Welfare Reform Act (Northern Ireland) 2007 on 1st April 2008.

Article 3 amends the Social Security and Child Support (Decisions and Appeals) Regulations (Northern Ireland) 1999 and the Social Security (Loss of Benefit) Regulations (Northern Ireland) 2002 consequential upon the coming into operation of section 45.
