These Regulations amend the Categories of Tourist Establishment (Statutory Criteria) Regulations (Northern Ireland) 1992 (“the principal Regulations”) which prescribe the criteria which must be met by an establishment in order for it to be eligible for allocation to one of the 8 categories of tourist establishment established by Article 12(1) of the Tourism (Northern Ireland) Order 1992 as amended by Article 2 of the Categories of Tourist Establishment Order (Northern Ireland) 2011(1).
Regulation 2(2) substitutes the Table as set out in Regulation 2 to the principal Regulations.
Regulation 2(3) makes a minor amendment to paragraph 7(2)(b) of Schedule 1 (criteria for hotels) to the principal Regulations.
Regulation 2(4) substitutes paragraph 8A of Schedule 1.
Regulation 2(5) amends paragraph 10(a) of Schedule 2 (criteria for guest houses).
Regulation 2(6) makes a minor amendment to paragraph 1(1)(c) of Schedule 3 (criteria for bed and breakfast establishments).
Regulation 2(7) amends paragraph 10(a) of Schedule 3.
Regulation 2(8) amends paragraph 10(a) of Schedule 4 (criteria for self-catering establishments).
Regulation 2(9) amends paragraph 11(2) of Schedule 5 (criteria for hostels).
Regulation 2(10) and Schedule 1 inserts 3 additional categories of tourist establishment by inserting new Schedules 6, 7 and 8 into the principal Regulations.
New Schedule 6 (criteria for a bunk house) prescribes the criteria which must be met by an establishment in order for it to be allocated to the category of bunk house. This is a category of tourist establishment which offers overnight shelter in a rural location.
New Schedule 7 (criteria for campus accommodation) prescribes the criteria which must be met by an establishment in order for it to be allocated to the category of campus accommodation. Campus accommodation is provided by educational establishments for their students and is made available to individuals, families or groups at certain times of the year.
New Schedule 8 (criteria for guest accommodation) prescribes the criteria which must be met by an establishment in order for it to be allocated to the category of guest accommodation. Guest accommodation is a category whose primary focus is the provision of bedrooms.
Regulation 3 and Schedule 2 revokes Regulations made under legislation prior to the coming into operation of the Tourism (Northern Ireland) Order 1992.

Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Rule and provides information about its policy objective and policy implications. They aim to make the Statutory Rule accessible to readers who are not legally qualified and accompany any Northern Ireland Statutory Rule or Draft Northern Ireland Statutory Rule laid before the UK Parliament during the suspension of the Northern Ireland Assembly.
