The Department of the Environment, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the prevention, reduction and elimination of pollution caused by waste, makes the following Regulations in exercise of the powers conferred on it by sections 2(2) of that Act and Articles 38(3) and 39 of the Waste and Contaminated Land (Northern Ireland) Order 1997(3).
