PART 8FORESTRY BUILDINGS AND OPERATIONS

Class A
Permitted developmentA.

The carrying out on land used for the purposes of forestry, including afforestation, of development reasonably necessary for those purposes consisting of—

(a)

works for the erection, extension or alteration of a building;

(b)

the formation, alteration or maintenance of private ways;

(c)

operations on that land, or on land held or occupied with that land, to obtain the materials required for the formation, alteration or maintenance of such ways;

(d)

other operations (not including engineering or mining operations).

Development not permittedA.1

Development is not permitted by Class A if—

(a)

it consists of or includes the provision or alteration of a dwelling;

(b)

the height of any building or works within 3 kilometres of the perimeter of an airport exceeds 3 metres in height; or

(c)

any part of the development is within 24 metres of the nearest part of a special road or within 24 metres of the middle of a trunk or a first or second-class road or 9 metres from the middle of other classes of road.

ConditionsA.2

Development is permitted in Class A(c) subject to the following conditions—

(a)

the surface of the land shall be levelled and any topsoil replaced as the uppermost layer; and

(b)

the land shall, so far as practicable, be restored to its condition before the development took place.

They aim to make the Statutory Rule accessible to readers who are not legally qualified and accompany any Northern Ireland Statutory Rule or Draft Northern Ireland Statutory Rule laid before the UK Parliament during the suspension of the Northern Ireland Assembly.
