The Food Hygiene Rating (Fee and Fixed Penalty Amount) Order (Northern Ireland) 2016

Coming into operation in accordance with Article 1(1)

The Department of Health(1), in exercise of the powers conferred by sections 4(7)(c) and paragraph 4 of the Schedule to the Food Hygiene Rating Act (Northern Ireland) 2016(2), makes the following Order.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Food Hygiene Rating (Fee and Fixed Penalty Amount) Order (Northern Ireland) 2016 and comes into operation forthwith.

(2) In this Order “the Act” means the Food Hygiene Rating Act (Northern Ireland) 2016

Fee for re-rating

2.  An application made to a district council for a review of a food business establishment’s food hygiene rating under section 4 of the Act must be accompanied by a fee of £150.00.

Amount of fixed penalty

3.  The fixed penalty in respect of an alleged offence under section 10(1) or (2) of the Act is £200.00.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order prescribes the fee to be charged for a review of a food hygiene rating (a re-rating).

This Order also prescribes the amount of fixed penalty payable under a fixed penalty notice served under section 10 (1) or (2) of the Food Hygiene Rating Act (Northern Ireland) 2016.
