The Department for Infrastructure(1), makes the following Order in exercise of the powers conferred by Article 57(2) of the Road Traffic Offenders (Northern Ireland) Order 1996(2) and now vested in it(3).
In accordance with Article 91(1) of that Order the Department has consulted with such representative organisations as it thinks fit.
1. This Order may be cited as the Road Traffic (Fixed Penalty) (Offences) (Amendment) Order (Northern Ireland) 2023 and shall come into operation on 15th May 2023.

2. In Schedule 1 to the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 1997(4) (fixed penalty offences), after the heading “Offences under the Road Traffic (Northern Ireland) Order 1995” and before item 20 insert—
“19A | Article 12 | Driving mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration.”. |

This Order amends Schedule 1 to the Road Traffic (Fixed Penalty) (Offences) Order (Northern Ireland) 1997 to specify an additional offence, relating to the driving of a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other persons using the road or place, to be a fixed penalty offence for the purposes of the Road Traffic Offenders (Northern Ireland) Order 1996.
