Coming into force in accordance with article 1
The Scottish Ministers, in exercise of the powers conferred on them by section 1(1) and (2) and section 24(3) of the Food and Environment Protection Act 1985(1), and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) Partial Revocation (No. 3) (Scotland) Order 1999 and shall come into force at 18.00 hours on 7th December 1999.
2. In this Order “the principal Order” means The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 1999(2).
3. The principal Order is revoked insofar as it designates any part of the area set out in the Schedule to this Order being within the area bearing the letter D described in paragraph 4 of the Schedule to the principal Order.

Article 3
The area of sea below high water spring enclosed by a line starting at 55°30'N 6°30'W; then North to Port Wemyss on Islay at 55°40.5'N 6°30'W; then east and north along the southern shores of Islay to Ardmore point on the east coast at 55°41'N 6°01.3W; then east to 55°41'N 6°W; then south to 55°30'N 6°W then west to the starting point.

This Order is the third partial revocation of the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (Scotland) Order 1999 (“the principal Order”) which prohibited–
(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4);
(b)movement of such scallops out of that area (article 5); and
(c)landing, using in the preparation of processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area (article 6).
The effect of this Order is to remove the prohibitions in respect of the area of sea designated in the Schedule to this Order, which forms part of the area of sea designated as Area D in the Schedule to the principal Order.
1985 c. 48; section 1(1) and (2) was amended by section 51(2)(a) and (b) of the Food Safety Act 1990 (c. 16); section 1(2) defines “designating authority”; section 1(2) was further amended by the Scotland Act 1998 (Modification of Functions) Order 1999 (S.I. 1999/1756). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
