The Cairngorms National Park Elections (Scotland) Order 2003

Explanatory Note

(This note is not part of the Order)

This Order sets out the arrangements under which direct elections to the Cairngorms National Park Authority shall be conducted.

It designates the returning officer of Highland Council as the returning officer for each election (article 3) and provides for expenses (article 4).

It divides the National Park into five wards, with each ward returning one member (article 5 and the Schedule to the Order). The map annexed to and forming part of this note gives a general guide to the wards and the area affected by this Order.

Provision is made for the filling of casual vacancies (article 8). It sets out provisions relating to qualification and disqualification for membership of the National Park Authority (articles 6 and 7). The timetable for conducting elections and provision regarding notice are detailed in articles 9 and 10.

The procedures for nomination of candidates are detailed in articles 11 to 16. Arrangements for the method of election, manner of voting (only by post), the form of the ballot papers and arrangements for absent voters are detailed in articles 17 to 25.

Part III of the Order sets out arrangements for the issue and receipt of ballot papers, the counting of ballot papers and the declaration of result (articles 26 to 50).

Part IV of the Order includes miscellaneous provisions relating to candidates' expenses and election returns (articles 51 to 53).
