The Scottish Ministers make the following Order in exercise of the powers conferred by sections 191 and 192 of the Housing (Scotland) Act 1987(1) and all other powers enabling them to do so.
This Order is made having taken into consideration the matters specified in section 191(3) of that Act.
In accordance with section 191(3) of that Act the Scottish Ministers have consulted such associations of local authorities as appear to them to be concerned.
In accordance with section 191(9) of that Act a draft of this Order, together with a report of the considerations leading to the provisions of the Order, has been laid before and approved by resolution of the Scottish Parliament.
1987 c. 26; sections 191(10) and 192(6) were amended by the Housing (Scotland) Act 1988 (c. 43), Schedule 8, paragraphs 4 and 5 respectively. See section 192(7) of the 1987 Act for the definition of “prescribed”. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). The requirement to obtain Treasury consent was removed by section 55 of that Act.
