The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 4(5) and (6) and 5(1) of the Refuse Disposal (Amenity) Act 1978(1) and sections 101(4) and (5) and 102(2) of the Road Traffic Regulation Act 1984(2) (“the 1984 Act”) and of all other powers enabling them to do so.
The Scottish Ministers have consulted with such representative organisations as they think fit in accordance with section 134(2) of the 1984 Act.
1978 c.3; sections 4 and 5 were modified by the National Parks (Scotland) Act 2000 (asp 10), schedule 5, paragraph 6; “prescribed” is defined in section 11(1). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).
