Amendment of the National Health Service (Free Prescriptions and Charges for Drugs and Appliances) (Scotland) Regulations 2011

2.—(1) The National Health Service (Free Prescriptions and Charges for Drugs and Appliances) (Scotland) Regulations 2011(1) are amended in accordance with this regulation.

(2) In regulation 2(1) (interpretation)—

(a)omit the definition of “the 2000 Regulations”; and

(b)after the definition of “the 2009 Regulations” insert—

“the 2015 Regulations” means the National Health Service (Charges for Drugs and Appliances) Regulations 2015(2);.

(3) In regulation 3(2) (supply of drugs and appliances)—

(a)in sub-paragraph (a)—

(i)for “the 2000 Regulations” substitute “the 2015 Regulations”;

(ii)for “1st April 2014” substitute “1st April 2015”(3);

(b)in sub-paragraph (b)—

(i)omit the words “and each quantity of drug”;

(ii)for “the 2000 Regulations” substitute “the 2015 Regulations”;

(iii)for “1st April 2014” substitute “1st April 2015”(4); and

(c)after sub-paragraph (b) insert—

(c)in respect of the supply of each quantity of a drug, the charge that is specified in regulation 3(1)(c) of the 2015 Regulations as in force at 1st April 2015(5)..

The charge specified in regulation 3(1)(a) of S.I. 2015/570 as at 1st April 2015 relating to the supply of elastic hosiery is £8.20 or £16.40 per pair.

The charge specified in regulation 3(1)(b) of S.I. 2015/570 as at 1st April 2015 relating to the supply of each other appliance is £8.20.

The charge specified in regulation 3(1)(c) of S.I. 2015/570 as at 1st April 2015 relating to the supply of each quantify of a drug is £8.20.
