PART 2 S RULES IMPLEMENTING THE PUBLIC CONTRACTS DIRECTIVE

CHAPTER 1 S SCOPE AND GENERAL PRINCIPLES

SECTION 1 S Scope

Exclusions: Concessions S

8.—(1) These Regulations do not apply to procurement for the award of [F1 a works concession contract or a services concession contract] which—

[F2 (a) is subject to the application of the Concession Contracts (Scotland) Regulations 2016,]

(b) would be subject to the application of [F3 those Regulations] but for any provision contained therein.

[F4 (2) In this regulation “works concession contract” and “services concession contract” have the meaning given in regulation 3 (meaning of “concession contract”) of the Concession Contracts (Scotland) Regulations 2016.]
