48.—(1) Schedule 1 (exclusions: mergers and concentrations) is amended as follows.
(2) In paragraph 4—
(a)for sub-paragraph 5(a), there is substituted—
“(a)it considers that the agreement will, if not excluded, infringe the Chapter I prohibition; and”; and
(b)sub-paragraph (6) shall cease to have effect.
