SCHEDULE 2 Contrary provision to section 11(1) and (2) of, and paragraphs 1 to 3 of Schedule 3 to, the Act and consequential amendments made as a result

PART 1 Contrary provision

Reserve Forces Non Regular Permanent Staff (Pension and Attributable Benefits Schemes) Regulations 2011

1.  Section 11(1) and (2) of, and paragraphs 1 to 3 of Schedule 3 to, the Act do not apply to Schedule 1, Part D, rule D.3, paragraph (4) and Schedule 2, Part C, rule C.2, paragraphs (4) and (5) to the Reserve Forces Non Regular Permanent Staff (Pension and Attributable Benefits Schemes) Regulations 2011(1).

PART 2 Consequential amendment

Reserve Forces Non Regular Permanent Staff (Pension and Attributable Benefits Schemes) Regulations 2011

2.—(1) The Reserve Forces Non Regular Permanent Staff (Pension and Attributable Benefits Schemes) Regulations 2011 are amended as follows.

(2) In Schedule 1, in Part D (death benefits), for rule D.3(4)(b) substitute—

“(b) the member was a man and was married to a woman whom he leaves a widow.”.

(3) In Schedule 2, in Part C (death benefits), in each of rules C.2(4) and (5)—

(a) in paragraph (c), after “married” insert “a woman”, and

(b) in paragraph (d), after “leaving” insert “her”.
