The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 2(1) and (9)(b) and 4(1)(b) of the Trade Act 2021(1).
In accordance with paragraph 4(1) of Schedule 2 to the Trade Act 2021 a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
1. These Regulations may be cited as the Conformity Assessment (Mutual Recognition Agreements) (Construction Products) (Amendment) Regulations 2021 and come into force on the day after the day on which these Regulations are made.
2. These Regulations extend to England and Wales, Scotland and Northern Ireland.
3.—(1) The Conformity Assessment (Mutual Recognition Agreements) and Weights and Measures (Intoxicating Liquor) (Amendment) Regulations 2021(2) are amended in accordance with paragraph (2).
(2) In Schedule 1 (specified Regulations), after paragraph 3 insert—
“3A. Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC(3).”.

These Regulations amend the Conformity Assessment (Mutual Recognition Agreements) and Weights and Measures (Intoxicating Liquor) (Amendment) Regulations 2021 (S.I. 2021/730) (“the 2021 Regulations”) to include Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (EUR 2011/305) in Schedule 1, making it a specified Regulation for the purposes of the 2021 Regulations.
This amendment is required in relation to the Protocol on the mutual acceptance of the results of conformity assessment to the Agreement on Trade Continuity between the United Kingdom of Great Britain and Northern Ireland and Canada (“the Agreement”) which requires the United Kingdom to accept conformity assessment procedures performed and conformity assessment results issued by a Canadian designated conformity assessment body in respect of construction products.
The Agreement was published in Command Paper 351 (“CP 351”). An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
